1. Acceptance of Terms
By registering for an account on minerAI, a platform developed and operated by Xuremi Inc. ("Xuremi", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you are accepting these terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.
2. Description of Service
minerAI provides a geospatial artificial intelligence infrastructure platform. Services include, but are not limited to, access to satellite imagery basemaps, tools for manual annotation and dataset generation, integration points for third-party machine learning models (e.g., Hugging Face), and high-speed inference mapping tools.
3. Acceptable Use and Restrictions
You agree to use minerAI strictly for lawful purposes, including but not limited to academic research, environmental monitoring, and regulatory compliance. You explicitly agree NOT to use the platform for:
- Targeting, tracking, or surveillance of individuals in violation of applicable human rights or privacy laws.
- Military targeting, espionage, or guiding weapons systems.
- Any activities that facilitate illegal resource extraction (e.g., using the platform to locate resources for the purpose of illegal mining).
- Attempting to reverse engineer, decompile, or extract the source code of the minerAI platform or its underlying infrastructure.
4. Intellectual Property and Data Ownership
Xuremi IP: The minerAI platform, its pipeline architecture, user interface, and proprietary algorithms remain the exclusive property of Xuremi Inc.
User Data: You retain full ownership of any custom datasets (e.g., drawn polygons, specific coordinate sets) you create on the platform. However, by using the platform, you grant Xuremi Inc. a non-exclusive, worldwide, royalty-free license to utilize anonymized, aggregated metadata (such as scan performance metrics and system usage statistics) to improve the platform's infrastructure and algorithms.
Third-Party Models: Xuremi claims no ownership over third-party models deployed via Hugging Face. Users are solely responsible for ensuring they have the legal right to deploy and run inference using models they connect to the platform.
5. Limitation of Liability and Disclaimer of Warranties
THE MINERAI PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. XUREMI INC. EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE.
Under no circumstances shall Xuremi Inc., its founders, employees, or partners (including the Mining Engineers Society of Kenya) be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your access or use of or inability to access or use the platform. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses, even if Xuremi has been advised of the possibility of such damages. Xuremi Inc. is not liable for decisions made or actions taken based on inference results generated by the platform.
6. Account Termination
Xuremi Inc. reserves the right to suspend or terminate your account and access to the platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Acceptable Use policy outlined in Section 3.
